Wakira Terms of Use

These terms are an agreement between you and HeiselSmart, which provides Wakira. By using the app you agree to them. Wakira asks you, once, to confirm that you are 18 or over and that you accept these terms and the privacy policy.
What Wakira is
Wakira is a sleep tracker, alarm clock and nutrition log. It records measurements from your phone and from a connected wearable, and shows you patterns in them.
What Wakira is not
Wakira is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. Nothing it shows you is medical advice. Its sleep figures, scores and observations are estimates derived from consumer sensors, and consumer sensors are not clinical instruments. If you are concerned about your health or your sleep, speak to a doctor.
Wakira is not an emergency service. If you or someone else is in danger, call your local emergency number.
The alarm
Wakira does its best to wake you, using several independent mechanisms. It cannot guarantee that an alarm will ring: a phone can run out of battery, be switched off, be silenced by the operating system, or have its permissions revoked. Do not rely on Wakira alone where missing a wake-up would cause you harm or loss. An alarm Wakira offers from your calendar or your shifts is an offer: it is set only when you accept it.
Answers written by a model
Answers to your questions, the monthly summary, a meal or a label read from a photo or a description, the setup instructions for a device and a voice made online are produced by models run by Google. They can be wrong. Check a figure that matters to you, and do not treat any of them as advice about your health. A conflict with a food restriction is a model's guess from a photo or a description; do not rely on it for an allergy, an intolerance or any medical diet.
Your account
Signing in is optional. If you do sign in, you are responsible for keeping access to your account. You may delete your account at any time from Settings. Wakira is intended only for people aged 18 or over. If you are under 18, do not use it or create an account.
Your data
You own the data you record. Wakira's handling of it is described in the Privacy Policy.
Night recording
Night recording can record anyone in the room. Tell the people who sleep or stay with you, do not use it to record other people's conversations, and switch it off when they do not agree.
Sleeping together
If you link your phone with another person's, each of you decides what you share, and either of you can unlink at any time. Link only with someone who agrees to it, and do not use the feature to watch anyone.
Your home
If you let Wakira switch devices in your home, you choose what it switches and when. A switch can fail to happen, or happen late, for reasons outside Wakira, so do not let anything that matters to safety, health or property depend on it.
Connected services
If you connect a third-party account such as a wearable service, your use of that service remains governed by that service's own terms. Wakira reads only what you authorise, and you may disconnect at any time.
Acceptable use
Do not attempt to break, reverse-engineer or interfere with the app or its servers, and do not use it in any way that breaks the law.
Availability and changes
Wakira may change, and features may be added, altered or withdrawn. Parts of it depend on services outside our control and may be unavailable at times.
Liability
Nothing in these terms limits liability that the law does not allow to be limited, or your rights under consumer protection law. Subject to that, Wakira is provided as it is, without warranty of any kind, and HeiselSmart is not liable for indirect or consequential loss, including a missed alarm or a decision made on an estimate the app displayed. Its total liability is limited to what you paid for Wakira in the 12 months before the claim.
Law and courts
These terms are governed by the laws of the State of Israel, and the competent courts in Israel have jurisdiction, without depriving you of protections the mandatory law of your country gives you.
Contact and changes
If these terms change, the date at the top changes with them. A change applies from that date, never to what happened before it.
